How HMM counts free time
HMM publishes its basic US free time and tariff in a search on its DEM/DET Tariff (Basic) page , by location, container type and demurrage or detention. The filed rules it cites are HDMU-040 Rules 101 and 101-1 for demurrage at destination and HDMU-038 Rule 21-2 for detention. What the page and Rule 21-2 say about counting:
- For import cargo, demurrage time runs from when the container enters a facility or depot until the full container is gated out. Detention time runs from that gate-out until the empty container is gated in at the assigned terminal or depot.
- Whether the free time is shown in calendar or working days, any date the terminal is not open is left out of the free time.
- Under Rule 21-2, detention free time counts the days the gate is open, Monday to Sunday. If appointments are available and you do not make one in time, the day still counts. After free time, detention is charged for every day the gate is open.
- Containers discharged at rail ramps follow the rail carrier’s demurrage tariff, not HMM’s port tariff.
- At some terminals in New York, Long Beach, Los Angeles, Oakland and Portland, HMM’s figure is its own demurrage only, and the terminal charges its storage separately.
A service contract can give different free time.
Before you pay
Compare the invoice with the tariff and with the contract. If the free time or the daily rate does not match, or the invoice leaves out what the FMC requires, see what a US invoice must show and how to dispute it . Other tools: last free day, any carrier .
