What the exclusions are
Since 2018 the Section 301 investigation of China’s technology-transfer practices has put additional duties on lists of Chinese products. USTR excluded certain products from those duties, and has extended the exclusions in steps. On December 1, 2025, USTR announced that it “has determined to extend the 178 current exclusions until November 10, 2026”, in line with the trade deal announced by the White House on November 1, 2025, as the notice itself describes (90 FR 55232).
| 9903.88.69 | 9903.88.70 | |
|---|---|---|
| What it covers | 164 exclusions | 14 exclusions for solar manufacturing equipment |
| Product list | U.S. notes 20(vvv)(i) to (iv) | U.S. note 20(www) |
| Entries covered (heading text) | June 15, 2024 through November 9, 2026 | January 1, 2024 through November 9, 2026 |
The 164 and the 14 come from the notice’s own history: 164 exclusions extended on May 30, 2024, and the fourteen solar exclusions announced on September 18, 2024. The headings’ dates in the table are read from the tariff schedule (USITC, 2026 Revision 21, checked 2026-10-21).
The last extension
- Notice: USTR, “Notice of Product Exclusion Extensions”, 90 FR 55232, December 1, 2025.
- New end date: goods entered “before 11:59 p.m. eastern daylight time on November 9, 2026”. The notice changed the text of both headings by “deleting ‘November 29, 2025,’ and by inserting ‘November 9, 2026,’ in lieu thereof”.
- Scope: an exclusion is “available for any product that meets the description”, and its scope is governed by the ten-digit statistical reporting number and the description in the U.S. note.
Corrections made since
The USITC changed some statistical reporting numbers on July 1, 2026. USTR then amended the notes so the exclusions cover the same products: four exclusions (91 FR 56538, September 2, 2026) and one more (91 FR 64211, October 7, 2026), each effective as of July 1, 2026. If an excluded product’s ten-digit number changed on that date, read the amended note, not an older list.
Where the product list is
The list is law text in the tariff schedule, not on this page: Chapter 99, subchapter III, U.S. notes 20(vvv)(i) to (iv) and 20(www), at hts.usitc.gov . The annexes to the earlier notices (89 FR 46948 and 89 FR 76581) list the products as announced. We do not copy the list.
What happens when an exclusion expires
The heading carries its own end date, so entries made after November 9, 2026 can no longer be reported under 9903.88.69 or 9903.88.70 unless USTR changes that date. In December 2025 it did so by a notice that edited the date in the heading text. The December notice says USTR “may continue to consider further extensions”, and we have not seen a later notice. On May 6, 2026, USTR also opened the second four-year review of the underlying China actions (91 FR 24636); that notice sets no end to the exclusions.
If your goods are on the list, check USTR’s Federal Register notices and the heading printed on your entry before shipments that will arrive after November 9, 2026. See also stacking order for where the 301 line goes on the entry summary and Section 232 tariffs for the other duty layers.
Frequently asked questions
How many Section 301 exclusions are still in force?
178, as of USTR's notice of December 1, 2025 (90 FR 55232): the 164 reported under 9903.88.69 and the 14 solar manufacturing equipment exclusions reported under 9903.88.70.
When do the current exclusions expire?
For goods entered before 11:59 p.m. eastern daylight time on November 9, 2026. The tariff schedule's own text for both headings says "through November 9, 2026".
Will USTR extend them again?
The notice says only that USTR "may continue to consider further extensions and/or additional modifications as appropriate". We have not seen a later extension notice.
Where do I find the HTS codes of the excluded products?
In U.S. notes 20(vvv)(i) to (iv) and 20(www) to subchapter III of Chapter 99 of the Harmonized Tariff Schedule at hts.usitc.gov. Each exclusion is limited to the ten-digit number and description printed there.
